- Confirmed return date: Established with the employee and, if applicable, the healthcare provider.
- Fitness-for-duty certification (if applicable): Required only if you have a uniform policy or practice of requiring it for the type of leave taken, and the employee was notified of this requirement at designation. FMLA allows you to require it for FMLA leave; rules differ for other leave types.
- Work restrictions or accommodation needs: Any limitations from the healthcare provider that will affect duties, schedule, or environment on return.
- Position confirmation: Verification that the employee's same or equivalent position is available and ready, or documentation of why an exception applies.
- Accommodation plan (if applicable): Written record of any accommodations agreed to through the ADA interactive process, ready to be implemented on the first day back.

- In writing: Always deliver the return-to-work notification in writing; email with a read receipt or a mailed letter both work. Verbal-only communication leaves you with no record of what was communicated.
- Before the return date: Send it early enough that the employee has time to ask questions and you have time to resolve any issues, at least several business days before the return date, not on the morning they walk in.
- Coordinate internally: Loop in the direct supervisor, HR, and any other relevant parties (IT for system access, facilities for workspace changes) before sending so you're not making commitments the organization can't meet by day one.
- Confidentiality: The notification itself can go in the personnel file. Any supporting medical documentation (fitness-for-duty certifications, work restriction letters, accommodation-related medical records) must be kept in a separate confidential file, not the general personnel file. This is an ADA requirement.

FAQs
Can we require a doctor's release before the employee returns?
For FMLA leave, yes, if you have a uniformly applied policy and notified the employee of this requirement in the original designation notice (WH-382). You cannot require it only for some employees or add the requirement after the leave has started. For non-FMLA leave, follow your policy and any applicable state law; the rules are less prescriptive but consistency is key. See the FMLA Requirements page for the designation rules.
What if the employee can't return to their exact previous job?
Under FMLA, the employee is entitled to the same position or an equivalent one: same pay, benefits, shift, and working conditions. If the position was legitimately eliminated in a RIF that would have affected the employee regardless of the leave, you are not required to create a new position. Document this carefully. Under the ADA, if the employee can't return to the original role even with accommodations, reassignment to a vacant equivalent position is itself a required accommodation before denial is permitted.
What if the employee wants to return before their leave is scheduled to end?
Under FMLA, you may require up to 2 business days' notice of an early return. Under the ADA, you generally must accommodate an early return if the employee is able to perform the job's essential functions. Check your leave policy for any internal notice requirements, and be consistent in how you apply them.

- Workers' comp return-to-work programs: Many states have formal return-to-work programs with specific forms, modified-duty requirements, or timelines for offering light-duty work. Some states impose penalties on employers who fail to offer suitable modified duty when available. Check your state workers' comp agency's employer guidance.
- State PFML reinstatement rights: State paid family and medical leave programs often have their own reinstatement protections that may differ from FMLA, including applying to smaller employers. Confirm whether your state's PFML law imposes separate reinstatement obligations. See the Other Leave Laws page.
- Unionized workplaces: Collective bargaining agreements may impose additional or different return-to-work procedures, seniority protections, or notice requirements. Follow the CBA alongside applicable leave laws; both apply.
- Intermittent leave: When an employee on intermittent FMLA leave returns after each absence, a formal RTW notification isn't typically needed. However, maintaining consistent records of each absence and return is still important for tracking leave usage.
